Yes. You can form it in any of the 50 states or in Washington, D.C., even if you don't live there. But if you form it in one state and operate in another, you'll usually need to register it in that other state as a “foreign entity” (foreign qualification; here “foreign” means formed in another state) and have a Registered Agent there. Each state defines what counts as doing business within its borders. Ask us about your case.
